Spey terms of use

1.1 These Terms of use form a legally binding agreement between the user ("You") and Speychain Limited ("company", "Spey", "we", "us", or "our").

1.2 Speychain Limited is a limited liability company registered in England & Wales No 14718933, located at 20 Arlington Street, London, SW1A 1RG, United Kingdom. Spey is a trading name of Speychain Limited.

1.3 Speychain Limited t/a Spey is an appointed representative of ITC Compliance Limited which is authorised and regulated by the Financial Conduct Authority (reference numbers are 1022125 and 313486 respectively).

1.4 Speychain Limited is registered with the Information Commissioner's Office (ICO) in compliance with the Data Protection (Charges and Information) Regulations 2018 under registration ZB748037.

1.5 These Terms of use apply to you accessing and using Spey's website https://speyfin.com/ (the "Website") and/or the Spey web application journey [insert link] (the "Web App") (together "the Platforms").

1.6 Our Platforms are directed to people residing in United Kingdom. The information provided on the Platforms are not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

1.7 Additional policies which also apply to your use of the Platforms include: our Privacy Policy and Cookie Policy. By using our Platforms, you will be regarded as having read and accepted the Privacy Policy and Cookie Policy. If you do not wish to be bound by the terms of the Privacy Policy and Cookie Policy, you should not use our Website or Web App.

1.8 If you decide to use one of our products or services you will need to agree to the specific terms for these too (for example, if you take out a loan through us) ("“Service Terms"”). 3.3 Use of the Spey Website

3.3.1 By using the Website, you agree not to:

• Engage in fraudulent, unlawful, or deceptive activities.
• Misuse our support services, engage in phishing, or submit false reports.
• Extract data or content without prior written permission.
• Circumvent security features or introduce malicious code.
• Use automated systems (e.g., bots, scrapers) without authorization.
• Transmit harmful software or disrupt the Website’s functionality.
• Copy, adapt, reverse engineer, or decompile any part of the Website.
• Remove copyright or proprietary notices.
• Harass, abuse, or threaten employees, agents, or other users.
• Falsely imply an affiliation with Spey or another entity.

3.4 Use of the Spey Web App

3.4.1 By using the Web App, you agree not to:

• Defraud or mislead us or other users, including attempts to gain unauthorized access.
• Modify, copy, or reproduce app content without written permission.
• Impersonate another person or access unauthorized accounts.
• Interfere with the service, including by introducing viruses or sending spam.
• Reverse engineer, decompile, or bypass security measures.
• Develop third-party apps that interact with the Web App without permission.
• Disrupt operations or services in any way.

3.4.2 If you receive a PIN, password, or other security credentials, you must keep them confidential. We may disable your access if you fail to comply with these terms.

3.4.3 While we strive to maintain reliable services, real-time data may become unavailable without notice. We will work to restore access within a reasonable timeframe.

3.4.4 Users are responsible for securing their devices from hacking, viruses, and other threats. Spey is not liable for security breaches or damages related to device security.

3.4.5 Performance may vary based on device type and internet connection. Spey is not responsible for hardware performance or connectivity issues.

3.5 We may suspend access to the Web App if we determine a violation of this policy.

3.6 You must inform us promptly of any changes to your account details or errors. You can also update your information through the Web App.

4.1 Information regarding an item that is required for the operation of Spey’s services such as a description of the item, its name and estimated value according to the auction house, marketplace or dealer must be provided when asked for while using the Platforms, or directly by Spey to enable Spey to assess its eligibility for finance. You may also be asked to provide further information related to it such as images, proof of ownership or evidence of authenticity. Any information you provide for this purpose must be accurate and complete.

4.2 You must not apply for Spey’s services with any item where you have any knowledge or concern that the item may not be authentic, or stolen.
‍
4.3 You must have the right to share any material concerning the item that you provide to Spey.
‍
4.4 If the application is regarding the consignment of the item, you must be the consignor and owner of it.
‍
4.5 You acknowledge and agree that all assessments, valuations, and related information that may be shared with you by Spey are for informational purposes only and do not constitute financial, investment, or legal advice. Spey does not guarantee the accuracy, completeness, or reliability of any valuation and shall not be liable for any loss, damage, or financial detriment arising from reliance on its services. Clients waive any claims, demands, or legal recourse against Spey related to discrepancies, market fluctuations, or subsequent sales based on the provided valuation.

4.6 By submitting data related to items such as descriptions, and images, proof of ownership, or evidence of authenticity for valuation you grant Spey a non-exclusive, royalty-free, and perpetual right to use, analyse, store, and aggregate such information for the purpose of improving Spey’s services.

5.1 All content on the Website and Web App, including but not limited to text, images, graphics, and software, is protected by copyright laws and owned by or licensed to Spey.

5.2 You may not reproduce, distribute, modify, or otherwise use our content without prior written consent.

6.1 "Spey" is a trademark of Speychain Limited in the United Kingdom under trademark number UK00003950391.

6.2 You are not permitted to use any of our trademarks without our approval.

This applies even if Spey has been advised of the possibility of such damages, including those resulting from errors, omissions, performance failures, unauthorized access, delays, transmission failures, malware, or other harm.

10.1 Subject to these Terms, we own all current and future intellectual property rights, including copyrights, trademarks (registered and unregistered), design rights, database rights, and any related rights on the Platforms, and all content published on them.

10.2 If any intellectual property rights automatically vest in you by law or otherwise, you agree to take all necessary steps, including signing relevant documents, to assign those rights back to us upon request.

10.3 You retain copyright ownership of any data you upload or submit to the Platforms. However, you grant us a worldwide, exclusive, royalty-free, non-revocable license to use, copy, distribute, publish, and transmit such data as outlined in these Terms and our Privacy Policy.
